Welcome to Kreators, a blockchain-based creator marketing platform that connects content creators ("Kreators") with brands and companies ("Brands") for promotional campaigns. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and Kreators. If you do not agree to these Terms, please do not use our platform.

Kreators is a decentralized platform that facilitates:

• Campaign creation and management for brands
• Creator discovery and application processes
• Content verification and performance tracking
• Automated payments through blockchain technology
• Analytics and reporting tools

We act as an intermediary platform and do not guarantee the success of any campaign or the quality of any content created.

To use Kreators, you must:

• Be at least 18 years old or have legal capacity to enter contracts
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Connect a compatible blockchain wallet for payments
• Comply with all applicable laws and regulations

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

As a Kreator, you agree to:

• Create original, high-quality content that meets campaign requirements
• Disclose sponsored relationships according to FTC guidelines and platform rules
• Meet all deadlines and deliverable requirements
• Maintain professional communication with brands
• Provide accurate audience metrics and engagement data
• Not engage in fraudulent activities, fake engagement, or bot usage
• Respect intellectual property rights of brands and other creators

As a Brand, you agree to:

• Provide clear, accurate campaign briefs and requirements
• Fund campaigns with sufficient USDC tokens before launch
• Review and approve content in a timely manner
• Pay creators according to agreed terms and platform schedules
• Respect creators' creative freedom within campaign guidelines
• Provide necessary brand assets and guidelines
• Comply with advertising standards and regulations

Payment Terms:

• All payments are processed in USDC (USD Coin) on supported blockchain networks
• Payments are automatically distributed upon campaign completion and content approval
• Kreators charges a platform fee of 6% on all campaign payments
• Brands may incur blockchain transaction fees (gas fees) for payment processing
• Refunds are subject to our refund policy and campaign terms

Blockchain Risks: You acknowledge that blockchain transactions are irreversible and may be subject to network delays or failures.

Content Ownership:

• Creators retain ownership of their original content
• Brands receive usage rights as specified in campaign agreements
• Platform content (analytics, reports) remains property of Kreators
• Users grant Kreators limited rights to display content for platform operations

Prohibited Content: Content must not include illegal, harmful, discriminatory, or infringing material.

We collect and process personal data according to our Privacy Policy. By using Kreators, you consent to:

• Collection of profile information and platform usage data
• Integration with social media platforms for verification
• Analytics tracking for platform improvement
• Communication for platform updates and campaign notifications

We implement industry-standard security measures to protect your data and use blockchain technology for payment transparency.

Prohibited Activities:

• Creating fake accounts or misrepresenting identity
• Using bots or artificial engagement methods
• Harassment, discrimination, or abusive behavior
• Circumventing platform fees or payment systems
• Violating intellectual property rights
• Attempting to hack or disrupt platform operations

Enforcement: We may suspend accounts, withhold payments, or take legal action for violations.

Platform Disclaimer: Kreators is provided "as is" without warranties. We do not guarantee:

• Uninterrupted platform availability
• Campaign success or specific results
• Accuracy of user-provided information
• Blockchain network reliability

Limitation of Liability: Our liability is limited to the fees paid to us. We are not liable for indirect, consequential, or punitive damages.

Either party may terminate their account at any time. Upon termination:

• Active campaigns must be completed or canceled according to terms
• Outstanding payments will be processed according to platform schedules
• Account data may be retained according to our Privacy Policy
• These Terms remain in effect for completed transactions

We may update these Terms periodically. Material changes will be communicated through:

• Platform notifications
• Email announcements
• Updated terms page with revision dates

Continued use of the platform after changes constitutes acceptance of new Terms.
